#1 Residential Trainings, Retreats & Stays At The Shanti Atma Ashram:
The terms and conditions below refer to any course, retreat, stay or in person or online event that is hosted by Shanti Atma Yoga.
Attendance
Participants agree that it is their responsibility to attend 100% of the course as required to receive the YACEP certification which is based on Yoga Alliance standards. 100% attendance includes the physical attendance of each participant but the full participation of the student within workshops and learning activities, with positive behaviour, leaning towards a yogic attitude overall.
Payment
There are two payment options:
1) Payment in full upon booking to secure a saving.
2) Payment in 2 or 3 transactions with 50% accounting for the deposit.
The remaining payment is required at any time up until 90 days prior to the start date of the course or retreat. If full payment is not paid within 90 days before the course or retreat start date then your place shall be advertised as available and no refund shall be given.
Under any other unique or personalised attendance agreement between Shanti Atma Yoga and an individual, the attendance of an in person or residential training course or retreat, recognises the full value of the investment, and the agreement to these terms and conditions. For example, but not limited to, a scholarship, an energy exchange, etc
If you have already made a payment and enrol into another program, Shanti Atma Yoga may request to make the payment through their payment system, removing any admin tasks from the participant, with the written permission or confirmation of the individual. With the written agreement of this payment, the participant agrees to these terms and conditions.
Shanti Atma Yoga will never make a payment without written consent from the participant.
By making any payment to Shanti Atma Yoga you agree to these terms and conditions
Deposits
50% of investment acts as a deposit which secures your space. This is non-refundable, and non-moveable, under any circumstance, and is used for course / retreat / venue preparations.
For late bookings (less than 90 days prior to the course start date) payment in full is required.
All deposits are strictly non-refundable. This reflects the costs we incur immediately in confirming your booking (including, but not limited to, venue costs, staff time, administration). Your booking is a commitment to attend, and once received, deposits cannot be returned.
If you cancel your place less than 90 days before the training/retreat start date, all fees paid are non-refundable.
If you make a booking for another person you warrant to us that you have their permission to do so.
If you have booked a Yin Teacher Training course:
Investment in the courses that Shanti Atma Yoga provides are primarily for the content and educational benefit of the course. The venue and other facilities are added value to the course content for a holistic wellness experience while learning.
COVID-19
All residential “in person” training courses are being rescheduled to further dates. Courses are being postponed and not cancelled.
Due to the global pandemic having adverse effects all over the world, the new course schedule will be released at a time where the effects have decreased and the situation has settled. For this we kindly ask for your patience and understanding.
All in person course bookings will be automatically moved to the next available training and will be valid until 1st January, 2024. Depending on the global COVID-19 situation, this may be extended if necessary. If another date cannot be found then the online training shall suffice for the training booked. However, Shanti Atma Yoga strives to provide multiple dates and locations to assure that other dates can be found, COVID – 19 dependent. This provides opportunities to find another training to attend.
*Note: Please note that Shanti Atma Yoga runs training courses in many countries in the world, however this deferral does not apply to a course location change to Australia (unless already booked into an Australian training).
Training courses are being rescheduled due to the financial obligations that Shanti Atma Yoga is under with paying training fees forward for all costs needed to run the training courses.
Participants will receive all training content online of their respective training, to compensate for any inconvenience caused by COVID-19, and to suffice for the full training content of the service booked. This enables self development and Yin Yoga teacher training to continue. Online training content is identical to the content of residential trainings. Participants receive lifetime access to present content and future updated content on an online portal with personal log ins.
As a gesture of goodwill and compassion, an additional 50 hour Yin Yoga training will be issued to each participant free of charge, for all those who have paid in full for their training.
All financials for online training are subject to normal terms and conditions, unless specified otherwise.
Shanti Atma Yoga works globally, and has a social responsibility to abide by government law and regulations for safety and is not prepared to put anybody’s health at risk. The in person training courses will resume when it is safe to do so. Until then we please ask for your patience.
If in the event the effects of covid becoming damaging for Shanti Atma Yoga’s in person training then the in person portion of the school will close down and all bookings shall be automatically moved online. In this case, extra training shall be provided to compensate for the inconvenience. A total of 200 hour training shall be provided to suffice for the value of the accommodation.
Booking & Discovery Call
Upon application a 45-minute discovery call will be held (at a selected time and date) to discuss your experience, challenges and goals. This is to ensure transparency of the booking process and to offer you the opportunity to ask questions regarding course content and logistics.
Currency Exchange
All courses will be a fixed rate in GBP (Great British Pound). If payment is being made from another currency the investment will be applicable to the exchange rate per day of payment and therefore fees and local currencies may fluctuate.
Cancellation & Rescheduling Course / Retreat Date & Stays At the Shanti Atma Ashram
Cancellation of Trainings, Retreats or Stays by Participant
If cancellation by participant is 90 days or more prior to the start of the course then 75% of payment is accountable for the cancellation fee.
If cancellation by participant is within the 90 days prior to the start date of the course or retreat then the payment is non-refundable.
This reflects the costs we incur immediately in confirming your booking (including, but not limited to, venue costs, food and beverage costs, deposits made to suppliers, staff time, administration, training materials, additional costs relevant to training or retreat, and securing your space so other people cannot book). Your booking is a commitment to attend, and once received, deposits cannot be returned.
Rescheduling of Trainings, Retreats or Stays By Participant
If participant requires to move to a different course or retreat date, instead of cancellation, then we will work with what is available to move you.
50% of the investment will be non-moveable in this case due to that 50% of securing your space and covering costs for your place on the course or retreat.
Rescheduling of Training, Retreat or Stay By Shanti Atma Yoga
Shanti Atma Yoga reserves the right to cancel or reschedule an event under any circumstances that make the event not viable to be carried out as advertised. Circumstances may include an event that is beyond the control of the company or any reason that the venue may have to cancel or reschedule. Events include illness of teacher trainers, cancellation of venue, low numbers in trainings, or any other unforeseen circumstance that makes the training not viable to be carried out. In the case of a cancelled or rescheduled event, Shanti Atma Yoga will:
A) Transfer your booking to a future course or retreat
and
B) In the case of a Yin Teacher Training will offer you the online course in the meantime so that training can still take place
In this case, the online training portal shall be issued to the participant.
If in any case of any force majeure event, then full payment will be transferred to another course date. However, Shanti Atma Yoga will not be held liable for any additional expenses which you may have incurred in respect to the event, for example travel, accommodation or exchange rate losses.
Shanti Atma Yoga will make every attempt to find a date and time that works for each individual. If a date and time does not work then online training shall be provided so that the participant can still attain the training. Training space of the participant will remain valid for 2 years after the booking date.
Where possible Shanti Atma Yoga will offer an additional option, that is personalised and unique to the situation, providing every attempt to provide the service of Yin teacher training (in person or online), or retreat experience to the participant.
If the participant declines the option to move to another training or retreat date offered, or shows unwillingness to work with Shanti Atma Yoga on options that are provided within the resources and time frame at hand, then that is the personal decision of the participant.
If Shanti Atma Yoga must cancel / reschedule a training due to force majeure reasons then please reference section “force majeure” of these terms and conditions.
Mentorship
Mentorship cancellation follows the same cancellation process as all training courses.
The deposit is non-refundable and secures your space.
Postponing Course
Upon special cases there may be a possibility to move the deposit or partial payment to another course location and date. Cases will be individually assessed and this will depend on availability of other courses.
Venue
Shanti Atma Yoga uses privately owned venues to run courses and retreats. Each venue has a variety of facilities which will be stated on the respective website of the individual venue. Participants are asked to contact the venue directly in terms of any questions in regard to venue facilities. Shanti Atma Yoga aims to use quality and suitable venues for a productive and positive learning environment.
Any issues with the venue shall be addressed with the venue directly.
Privacy
All personal details shared with Shanti Atma Yoga are fully confidential and shall not be shared with any other person or company for any reason.
Course / Retreat Content
The course content taught by Shanti Atma Yoga is separate from the venue in which it is taught in.
The course content is exclusive to participants who have attended the course and participants agree not to share content with people who have not attended the course.
Day Off
In between week 1 and week 2 there is a day off (free day) for participants to rest, refresh and rejuvenate. On this day there shall be no classes and the teachers shall not be available. Participants are free to use all facilities available to them (venue dependent) and are encouraged to explore the surroundings.
Food is not officially offered on this day unless specifically stated at the venue
Force Majeure
A “force majeure” clause is a contract provision that relieves the parties from performing their contractual obligations when certain circumstances beyond their control arise, making performance inadvisable, commercially impracticable, illegal, or impossible. E.g natural disasters, illness, pandemics, government restrictions.
In any event of a force majeure clause which results in Shanti Atma Yoga having to cancel or reschedule a course, either before the course start date or in the middle of a course, then the following procedures will take place:
A) Before the course starts: Transfer to a future course
B) In the middle of a course: Remaining value shall be transferred to a future course
C) New course dates may be added to the calendar
D) Online course may be available (course dependent)
Shanti Atma Yoga has the right to reschedule or cancel any event (online or residential) shall the need arise.
Liability
By attending any Shanti Atma Yoga course, retreat or event you agree that
- Teachers cannot be held responsible for or liable for any injury, loss or damage of property or disruption of any program beyond their control.
- It is your responsibility to be conscious of and look after your body and declare any previous or current injuries. Medical forms will be required upon arrival.
By making payment, and or attending, a training or retreat, you agree that Shanti Atma Yoga is not liable for any travel costs involved in getting to any destination where the training or retreat may be held.
Photos
Participants agree that they may be in marketing collateral i.e. photos on website
Forms
Upon arrival / orientation of course participants will be asked to fill out a medical form, consent form and a responsibility / liability waiver. This is to ensure that previous and current injuries and health conditions are clear to all teachers and that each participant agrees to take full responsibility of their body and overall health (physically, mentally and emotionally) while attending a course.
Upon booking you will be asked to sign a liability waiver. This must be filled out within 24 hours of making payment / booking any training or retreat (either in person or online). Failure to do so will deem your booking incomplete.
Website
Unless agreed to in advance you may not download any content from Shanti Atma Yoga website to be used commercially or for business purposes. If used for personal use (which may include reasonable use on social media) you agree to always source Shanti Atma Yoga and not to amend any of the content sourced.
Transport to and from venue
Transfers are not included in the investment of the course. Participants are responsible for making their own way to the venue. Venues can be contacted directly for individual or group transfers. This includes flights and airport to venue transfer.
We require all participants to obtain comprehensive travel and teaching insurance to cover cancellation, personal injury, and other unforeseen circumstances.
Food
In residential courses, food is included during the days with education. On days off participants will be responsible for providing their own food in local cafes,
#2 Shanti Atma Ashram Venue Hire
Venue Hire
Venue hire for the Shanti Atma Ashram is calculated per night and is 100% non-refundable under any circumstances.
Cancellation
If cancellation is by retreat leader then 100% of the payment is the cancellation fee, unless specific otherwise.
In the unlikely event that Shanti Atma Yoga must cancel your booking due to unforeseen circumstances (e.g. severe damage to property, force majeure), we will:
- Provide as much notice as possible.
- Offer to reschedule the event, subject to availability.
- If we cannot find another available time will offer a refund
We are not liable for any other costs incur.
Rescheduling
If reschedule is by retreat leader and is 90 days or more prior to the booked date then 50% is non-moveable and 50% is transferrable to other dates that are available.
If reschedule is by retreat leader and is 60 – 90 days or more prior to the booked date then 75% is non-moveable and 25% is transferrable to other dates that are available.
If reschedule is by retreat leader and is 0 – 60 days or more prior to the booked date then 100% is non-moveable.
Check in & Check Out Times
Retreat leaders will have access to the property at 3pm and check out is 11am.
Responsibility & Liability
Use & Care of Property
The retreat leader is responsible for ensuring that all guests, staff, and attendees respect and maintain the condition of the property and its contents throughout the hire period
Any damage to the property, furnishings, equipment, fixtures, or outdoor areas caused by the retreat leader or their guests will be automatically charged to the retreat leaders card/account that was used for the booking, which is held on file. A security/damage deposit may be held or requested to cover such incidents.
The retreat leader must report any damage or breakages immediately. The venue owner reserves the right to invoice for repair or replacement costs as deemed necessary.
Personal Belongings & Safety
The venue owner is not responsible for the loss, theft, or damage of personal items belonging to the retreat leader, guests, or any third-party service providers hired by the retreat leader.
It is the responsibility of the retreat leader to ensure the safety and security of personal belongings during the stay.
Shanti Atma Yoga accepts no liability for accidents, injury, loss, or damage resulting from the retreat leader and their guests, or third-party service providers (e.g. caterers, yoga instructors, sound healers) brought onto the premises by the retreat leader.
Shanti Atma Yoga is not liable for any injuries or accidents that occur during the use of indoor or outdoor facilities, including (but not limited to) pools, hiking trails, fire pits, or fitness areas.
During the months of May – October the retreat leader understands that it is against the law to have fires in the Andalusian mountain region and shall avoid fires such as fire ceremonies, candles and incense outside, any smoking in or around the property, and any other activity that includes an open flame.
The Shanti Atma Ashram is a non smoking property and retreat leaders will ensure that their guests don’t smoke in and around the property.
Travel & Teaching Insurance
We require all retreat leaders and organisers obtain comprehensive travel and teaching insurance to cover cancellation, personal injury, and other unforeseen circumstances.
Shanti Atma Yoga takes no responsibility in any travel changes or costs accumulated for travel.
Force Majeure
Shanti Atma Yoga accepts no liability or obligation to refund monies paid if the retreat is cancelled or disrupted due to events beyond their reasonable control, such as extreme weather, fire, flooding, pandemic, government restrictions, or natural disaster.
We will work as diligently as possible to deal with force majeure circumstances as they arise in a fair and timle manner.
Yoga Props
The retreat leader understands and agrees to keep the yoga props in good condition, clean and kept in their proper storage place provided.
Any damage to the props, other than general wear and tear, will incur a cost for repair or replacement from the retreat leader and shall be charged accordingly.
#3 Online Training Programs
Online Course Program Cancellation & Refund
All online programs enrolments (purchases) are non-refundable due to the time, effort and energy that has gone in to create them for you.
Once you have made any payment you accept these full terms and conditions and the service has started.
Once the logins and materials have been issued to you the service is no longer changeable.
If you enrol into a program and then decide to pull out for extenuating circumstances, before your first payment of your plan has commenced, a minimum charge of £250 will be charged on the account you enrolled with, due to the time, effort and support the whole Shanti Atma Yoga team has given to you.
Student Agreement
Upon enrolling into the Profitable Yoga Teacher Mastermind or the Yin Teacher Empowerment Program, you are required to sign a student agreement stipulating your commitment to the program and yourself. This also includes how to make the most of your program with significant prompts on what steps to take to make your experience a successful one.
If you do not sign the agreement then you lose any right for any material, service, coaching or support without the right to a refund.
Shanti Atma Yoga reserves the right to remove you from any training or coaching program if you display any abusive behaviour, without a refund.
Please note that while Shanti Atma Yoga will train, coach and support you in developing your Yin Yoga teacher and Yoga business, coaching, training and support will not be given in the arena of building a yin yoga teacher training or teacher training school. Upon signing the student agreement, you agree to these terms and conditions.
Login Access
Log ins for the online course are solely for the exclusive use for the student and nobody else. If these log ins are shared with anyone else then the account shall be frozen and no refund shall be given.
Online Course Payment
– Spaces are limited on the online course due to live work with the teachers
– Log ins will be issued once 100% of payment has been received unless specified otherwise
– Payment is non-refundable and represents a commitment to you, your teaching path and your business.
– Payment plans are possible and should be discussed upon booking:
– A non-refundable deposit is possible to secure a space on the online course
– Any bundle of training that is purchased is non-refundable as we honour the work of the teachers who are a part of the bundle and offer ongoing training and support
– If payment plan is agreed, scheduled and organised then this marks enrolment onto the course and the course is non-refundable. The first payment is non-moveable and will be processed upon initial agreement.
– If payment date needs to be moved then this may be possible upon special circumstances.
– Online courses are non-refundable.
– If payment plan stops mid way then course access will be blocked
Pay Plan
If you have signed up with a payment plan for any training bundle, the payment must complete on a monthly basis.
If the payment defaults then you will be liable to pay the full investment of the training bundle noted on the call.
By purchasing and committing to any program, training or course, facilitated by Shanti Atma Yoga, you accept these terms and conditions.
#3 Membership Subscriptions
All Inclusive Yin Training Membership Subscription
By subscribing to the all Inclusive Yin training membership subscription you agree to a minimum of 12 payments and understand that this membership is is non-refundable.
You also agree to the to the terms of this program and will not share any sensitive information outside of the program, that gets shared with you, that is confidential to Shanti Atma Yoga.
You understand that you can terminate this membership at any time after the 12th payment (12th month), with one month notice and all access will cease.
Other memberships
By subscribing to any ongoing membership from Shanti Atma Yoga you agree to a minimum of 6 months commitment.
Cancellation may be requested any time after 6 months, with 30 days notice.
Law & Courts Jurisdiction
These terms shall be governed by the laws of England & Wales and disputes submitted to the exclusive jurisdiction of its courts.
These Terms and Conditions, together with any documents expressly referred to herein, constitute the entire agreement between Shanti Atma Yoga and the participant. They supersede and extinguish all prior discussions, correspondence, negotiations, understandings or agreements, whether written or oral, relating to the subject matter.
No statement, representation, assurance or warranty made by any person (including staff, teachers, assistants, or representatives of Shanti Atma Yoga) shall have any legal effect unless expressly included in these Terms and Conditions.
